Enrolment terms and conditions

These terms and conditions form part of Siobhan Tierney Yoga & Meditation enrolment agreement with you and apply to the program you have specified and for which you wish to enrol, to the exclusion of all other terms and conditions issued or stipulated by anyone other than Siobhan Tierney Yoga & Meditation. In these terms and conditions, all references to ‘I’, ‘we’ and ‘us’ mean Siobhan Tierney and Siobhan Tierney Yoga & Meditation.

1. Payment for Enrolments

If you pay in full when you enrol then you are eligible for the special ‘paid in full’ pricing—otherwise you will be charged the payment plan pricing and placed on a payment plan (where available). If you do not set up a payment plan within 7 days we reserve the right to cancel your enrolment and a refund will not be available. In either case you are responsible for the full payment of fees for the entire Program regardless of whether you actually attend, complete or use all of the component events, products or inclusions (as applicable).

From time to time, there may be the option for an “early bird” reduced rate. To receive the “early bird” rate you must enrol by the “early bird” due date.

2. Payment Plan Must be Up to Date and Complete

All fees must be paid on time in order for you to attend and participate in the Program. For ongoing Programs this means if your payment plan is not up to date then you will not be allowed to attend the next event in the Program, and you must have finalised all payments in order to attend the final event. Program privileges including memberships, media, websites and other assets may be revoked, disabled or withheld as we deem appropriate if payments are not made.

3. Payment Plan Administration

If paying by direct debit or making an automated payment via the website, any changes to your payment details must be received in writing to siobhan@siobhantierney.com 5 days prior to your next scheduled debit date. It is your responsibility to advise us and refunds will not be given due to your failure to notify us within this time.

4. Program Completion Term

All Programs must be completed within the stated program terms. There will be no credit for enrolments not completed within this time. For missed weekly classes, if there is another suitable class for you to attend you can make up a class, where space is available. However you must request the transfer at least 48 hours before the class being transferred to. If there are no suitable classes to attend a make up class, refunds and credit will not be given for missed classes.

Make up classes and transfers can only be to classes managed and run by "Siobhan Tierney Yoga & Meditation".  You are unable to transfer to classes run by other studios where the class teacher is employed as a teacher.

For adult's General Hatha Yoga classes, when signing up for the term you receive access to an online library of classes. If you miss a class due to illness or a scheduling issue, you can pick a class from the library to do as a make up class.

5. Program Changes

If for any reason we deem it necessary to change any online course, workshop or retreat dates, content, title or hours we may do so by notifying you of the changes we make. You will have the option for a refund, transfer or credit under these circumstances.

In the event that we change any dates requiring physical attendance, you can reschedule your enrolment without penalty if you want to, providing alternative dates are available.

If there are any changes due to COVID-19 regulations, or if we deem it necessary to make changes to ensure the safety of students and teachers, you will have the option to receive credit or a refund for remaining classes.

6. Enrolment Cancellation

All registrations in all Siobhan Tierney and Siobhan Tierney Yoga & Meditation courses, events and retreats are non-refundable. ​If you do not attend a Program component in which you are enrolled a refund or credit is not available and you will need to purchase the Program again if you wish to attend a future similar event.

However credit or transfer to an alternative course may be offered in some circumstances. Please speak to your teacher regarding your individual circumstances.

A minimum of 48 hours is required to reschedule a private or corporate class. A minimum of seven days is required to cancel or reschedule attendance at a term course, retreat or workshop.

7. Product Warranty (if applicable)

If any product that you receive with your enrolment is found to be faulty, our only obligation to you is to replace the faulty product within 10 business days of your written request and return of the faulty product.

8. Partner/Friend discount (if applicable)

If you are enrolled in this program as the partner or friend of a full fee paying participant and you have received a partner or friend discount on the Program, should your linked full fee paying participant cancel their enrolment your discount will no longer apply and you will be required to pay the full fee for the Program.

9. Financial, legal and medical advice disclaimer

We make no representation and give no warranty to the accuracy or completeness of the information provided at or in relation to this Program and do not accept responsibility for any errors or inaccuracies in, or omissions from, the information contained therein. The information provided during or in relation to the program is for general purposes only and it does not purport to be comprehensive or to render specific advice. Nor should it be regarded as financial, legal or medical advice. If any information or advice that may constitute financial, legal or medical advice is given at or in relation to an event, such advice is not authorised by Siobhan Tierney Yoga & Meditation and does not constitute financial, legal or medical advice given by Siobhan Tierney Yoga & Meditation . This disclaimer does not purport to exclude any warranties implied by law which may not be lawfully excluded.

Please inform your teacher in writing before each class, of any recent injury, illness, surgery or any other conditions or events that may affect the attending person’s ability or focus during Yoga class. This can be done by emailing ​siobhan@siobhantierney.com​.

 

You acknowledge that the person/people attending are fit and well, and able to participate in the event. The attending person will take responsibility and care for themselves during class. All physical activity, including Yoga involves some risk of injury and each attendee must accept full personal responsibility for any personal injuries that may be sustained. It is the attending person’s responsibility to get medical clearance to practice Yoga with respect to any past or present injury, illness, medication or any condition that may affect the their participation.

For online classes, including free videos on the website, the attending person must have a safe place, free of obstructions, to undertake the class in. The attending person will dress in clothing that is not restrictive and is suitable for the activities. The attending person will take full responsibility for their health and safety.

10. Intellectual Property

All material relating to the Program for which you are enrolling whether presented during, before or after the Program, is subject to copyright and other intellectual property rights. The copyright in all such materials remains the property of their owners and may not be recorded, used or reproduced, without the written permission of the copyright owner. You agree not to do anything, at any time that would infringe the intellectual property rights in such materials.

For online classes, I agree not to record the class. Any recording made is the Intellectual Property of the teacher.

By participating in any online course, program, event, retreat or workshop with Siobhan Tierney Yoga & Meditation you consent to having your voice (only) recorded and these recordings may be sold at a later date. You also agree that there will be no financial or other form of compensation for you for this.

11. Confidentiality

We respect your privacy and must insist that you respect the privacy of other fellow participants. You agree not to disclose proprietary information, ideas, plans and trade secrets that are disclosed by other Participants in confidence, nor to violate the publicity, privacy or intellectual rights of any Program participant.

12. Application Approval and Termination of program enrolment

We are committed to providing all participants with a positive experience and may not approve all applications to join these programs. In this case we will refund you the amount paid to us less any enrolment cancellation costs. Once the Program starts, we may terminate this agreement and your participation in the Program without refund or forgiveness of remaining payments if you become disruptive or difficult to work with, if you fail to follow the Program guidelines, or if you impair the participation of others.

13. General

The laws of the state of Queensland govern this agreement. Should any part of this agreement be determined by court to be invalid or unforeseeable, the remainder of the agreement will be unaffected. This agreement may not be varied except with the written approval of Siobhan Tierney Yoga & Meditation. All terms, conditions and warranties implied by statute that are excludable are excluded from this agreement. Such terms, conditions and warranties implied by statute that are not excludable are not excluded from this agreement but our liability for breach of such conditions and warranties implied by statute that are not excludable is limited to the total amount paid by you to Siobhan Tierney Yoga & Meditation under this agreement.

14. COVID-19 policy


For in-person classes you agree to the following terms.

 

  • Class venues will adhere to have 4m squared space per person.

  • Please space your mat adequately apart from others'.

  • Students must not attend class if they are unwell or have been around someone diagnosed with Covid-19 in the last 14 days.

  • Students are to wash or sanitise hands before class.

  • There will be no physical contact between people during class.

  • Students must bring their own mat and any other props they would like to use. Suggested props are two blocks, a bolster and a Yoga strap.
